Terms of Service
The agreement between you and xigzag, in plain words. No surprises, no buried clauses.

1. The agreement
These Terms of Service ("Terms") are between you ("you", the account holder) and xigzag ("we", "us"). They govern your use of xigzag — the platform you use to create, edit, host and run websites. By creating an account or using the service, you agree to these Terms. If you're agreeing on behalf of a company, you confirm you have the authority to do so.
2. Your account
You must provide accurate information and keep your login secure. You're responsible for activity under your account. You must be old enough to form a binding contract where you live. We offer optional two-factor authentication — we recommend turning it on.
3. What you can build
You may use xigzag to build and run legitimate websites and businesses. You may not use it for anything illegal, deceptive or harmful — see our Acceptable Use Policy, which is part of these Terms. We may suspend or remove content or accounts that breach it.
4. Your content and your sites
You own the content you put into xigzag and the sites you create. You grant us the limited rights we need to host, process, back up and display your sites and to operate the service. Your site is a portable, exportable document — it stays yours. You're responsible for having the rights to the content, images and trademarks you upload.
5. Plans, billing and your customers' payments
You can build for free. Going Live is $19 per site each month (first month free), after which a site that uses more than its included quota grows gently, per unit, with no tier cliffs. You can set a monthly spend cap; we pause over-quota growth at your cap rather than bill past it. Fees are charged in advance and are non-refundable except where required by law.
When your site sells something, your customers pay you directly through your own connected payment provider (such as Stripe). We take 0% of those sales — that money never passes through us. You are the merchant of record for your storefront and are responsible for fulfilment, taxes, refunds and customer service on your sales.
5a. Your duties as a merchant
When you sell to consumers you are the trader and must meet the consumer-protection law of the places you sell to. xigzag gives you the tools (legal page templates, a checkout terms box, order emails, a returns flow); using them correctly is your responsibility. In particular, for sales to consumers in the EU, EEA and UK you must:
- show your trader identity and geographic address, and a way to contact you quickly (Consumer Rights Directive 2011/83/EU, Art. 6; E-Commerce Directive Art. 5);
- give the pre-contract information before the order: the main characteristics, the total price including taxes and delivery, payment, delivery and complaint arrangements;
- inform consumers of the 14-day right of withdrawal for distance sales, its exceptions (e.g. made-to-order or sealed hygiene goods, digital content supplied with the consumer's express consent) and provide the model withdrawal form, and refund within 14 days of withdrawal;
- label the order button with words such as "order with obligation to pay" and confirm the contract on a durable medium (the order email does this);
- show a prior price for any announced price reduction (Omnibus Directive, Price Indication Directive Art. 6a) and disclose whether and how reviews are verified;
- honour the legal guarantee of conformity for goods (at least 2 years in the EU), and provide an online-dispute-resolution or ADR link where your law requires it.
You are also responsible for your own privacy notice and cookie consent toward your shoppers; our Data Processing Addendum covers our role as your processor.
6. Free sites
A free site is genuinely free to build and publish. If you never go Live, we keep it for 30 days and then a further grace period; an unactivated free site may be removed on day 45. Go Live any time to keep a site indefinitely. We'll always show ad-free sites — we never inject advertising into a site we build.
7. Availability and changes
We work hard to keep the service available and your sites online, but we don't guarantee uninterrupted service. We may add, change or remove features. If we make a materially adverse change to a paid feature you rely on, we'll aim to give reasonable notice.
8. Suspension and termination
You can stop using xigzag and close your account at any time. We may suspend or terminate accounts that breach these Terms or the Acceptable Use Policy, that create risk for the platform or others, or as required by law. On termination you can export your sites for a reasonable period before data is deleted.
9. Warranties and liability
The service is provided "as is" and "as available". To the extent permitted by law, we disclaim implied warranties. We are not liable for indirect or consequential losses, lost profits or lost data, or for losses arising from your sales to your own customers.
Cap. Our total liability arising out of or relating to these Terms, in contract, tort (including negligence) or otherwise, is limited to the fees you paid us for the service in the 12 months before the event giving rise to the claim.
What the cap and exclusions never limit. Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence or wilful misconduct; (d) any right a consumer has under mandatory consumer law that cannot be excluded or limited (including the Ontario Consumer Protection Act, 2002, other Canadian provincial consumer laws, and EU/UK consumer law); or (e) any other liability that cannot be limited by law.
9a. If you are a consumer
If you use xigzag as a consumer (not for a business), you keep every right the mandatory consumer law of where you live gives you, and nothing in these Terms takes them away.
- Ontario and the rest of Canada. Where the Ontario Consumer Protection Act, 2002 applies (an internet agreement with an Ontario consumer), we disclose the information it requires before you agree, give you an express opportunity to accept or decline and to correct errors, and send you a copy of the agreement within 15 days. You may cancel an internet agreement within 7 days after receiving the copy if we did not make the required disclosure or deliver it as required, and the Act's protections against unfair practices apply. Any clause requiring arbitration or limiting class proceedings does not apply to you where the Act forbids it, and you may bring a claim in the courts of Ontario. The rules of other provinces apply the same way to their residents.
- EU, EEA and UK. You have a 14-day right to withdraw from a paid plan bought online. When you buy, you can ask us to start the service at once and confirm you understand that you lose the right once the service has been fully performed; if you withdraw before then you get a pro-rata refund of the period not yet used (Consumer Rights Directive Art. 14(3) and 16(a)). To withdraw, email hello@xigzag.com or use the model withdrawal form; we refund within 14 days.
- Your home courts. A consumer may always bring proceedings in the courts of the place where they live, and the mandatory law of that place still protects them.
10. Governing law and changes to these Terms
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein; the courts of Toronto, Ontario, without regard to conflict-of-laws rules, and each party submits to the non-exclusive jurisdiction of those courts, subject to the consumer rights in section 9a. We may update these Terms; for a material change we give at least 30 days' notice by email and in the Studio, and you may close your account before it takes effect. Continued use after the effective date means you accept the updated Terms.
